1. Service Description

Sens-AI is a SaaS (Software as a Service) platform that provides AI chatbot services for businesses. Our service enables clients to deploy intelligent conversational assistants to interact with their own customers and improve their business processes.

These Terms of Service (hereinafter "Terms") govern access to and use of the services offered by Sens-AI, accessible via sens-ai.biz and associated interfaces.

By accessing our services or creating an account, you unconditionally accept these Terms.

2. Account Creation and Responsibilities

To use Sens-AI services, you must create an account by providing accurate and up-to-date information. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity conducted under your account
• Keeping your account information up to date
• Immediately notifying us of any unauthorized use of your account

Sens-AI reserves the right to suspend or delete an account in case of violation of these Terms.

3. Acceptable Use Policy

When using our services, you agree not to:

• Use the service for illegal or unauthorized purposes
• Attempt to circumvent the platform's security measures
• Transmit illegal, defamatory, or rights-infringing content
• Use the service to send spam or unsolicited communications
• Reverse-engineer the service or its components
• Deliberately overload the service infrastructure
• Resell or redistribute the service without prior written authorization

4. Intellectual Property

All elements composing the Sens-AI service (software, interfaces, text, graphics, logos, trademarks) are protected by intellectual property law and remain the exclusive property of Sens-AI.

Content generated by the AI chatbot as part of the client's use of the service remains the client's property. However, Sens-AI reserves the right to use anonymized and aggregated data to improve its services.

Any unauthorized reproduction, representation, or use of service elements constitutes infringement punishable by law.

5. Service Availability and Limitations

Sens-AI strives to maintain the service accessible 24/7. However:

• The service may be temporarily interrupted for maintenance operations
• Sens-AI does not guarantee 100% availability and cannot be held liable for interruptions
• AI chatbot responses are automatically generated and may contain inaccuracies
• The service does not constitute professional advice (legal, medical, financial, etc.)
• Service performance may vary depending on technical conditions

6. Pricing and Payment

Use of Sens-AI services requires a subscription at rates defined according to current offers. Different plan tiers are presented on our website.

• Prices are indicated in euros and exclude taxes, unless otherwise stated
• Billing is monthly or annual depending on the chosen plan
• Payment is due on the date indicated on the invoice
• In case of late payment, Sens-AI reserves the right to suspend access to the service
• Any pricing changes will be communicated with 30 days' notice

7. Data Protection

Sens-AI is committed to protecting users' personal data in compliance with the General Data Protection Regulation (GDPR).

8. Limitation of Liability

To the extent permitted by law:

• Sens-AI shall not be liable for indirect damages resulting from the use of the service
• Sens-AI's total liability is limited to the amounts paid by the client in the last 12 months
• Sens-AI does not guarantee the accuracy of AI-generated responses
• The client is solely responsible for the use made of chatbot-generated responses
• Sens-AI cannot be held responsible for service interruptions due to force majeure

9. Termination

The client may terminate their subscription at any time from their personal dashboard. Termination takes effect at the end of the current billing period.

Sens-AI reserves the right to terminate access to the service in case of:

• Violation of these Terms
• Non-payment after formal notice
• Fraudulent or abusive use of the service

In case of termination, the client may request data export within 30 days following the end of service.

10. Governing Law

These Terms are governed by French law.

In case of a dispute relating to the interpretation or execution of these Terms, the parties shall endeavor to find an amicable solution. Failing that, the dispute shall be submitted to the competent courts of Paris, France.
